Traffic Law

The recent change in New York Vehicle & Traffic Law sec. 1806 makes it much harder to fight traffic tickets in New York State now. In most cases in New York, prior to the change, a person would only have to appear one time to fight a routine traffic infraction (eg. speeding, unsafe lane change or failure to signal). The Vehicle & Traffic Law made it clear that upon receipt of a "not guilty" plea from a motorist the Court was required to schedule the matter for a trial, and on the trial date the motorist could plea bargain or proceed to trial. Multiple appearances were then recognized to be an unnecessary burden on motorists, many of which would then feel coerced to plead guilty rather than appear again and again for a rather routine matter.
Well, not any longer. Our Legislature and Governor have once again forgotten the working class. Rather than incur the expense for officers to appear and prosecute their tickets, they decided to pass the burden to the thousands of motorists instead and issue an "appearance" date. If you want a "trial"... you will have to take additional time off and come back again...and possibly again. The consequence is that the motorists is required to make multiple appearances to fight their traffic tickets. Ironically, a similar practice was actually critically identified by the New York State Commission on Judicial Conduct to likely coerce guilty pleas.
Motorists who receive tickets need to understand that we can make these appearanceswithout them being present.
